Last Will and Testament of Clarence T Johnson

LAST WILL AND TESTAMENT OF CLARENCE T JOHNSON
     I, Clarence T Johnson of Valparaiso, Saunders County, Nebraska, being of sound mind and disposing memory, do hereby make, publish and declare this to be my Last Will and Testament:
     1.  I direct that my executor, herein named, pay all my just debts, my funeral expenses, and the expenses of administering my estate.
     2.  I hereby authorize and direct said executor to sell all the real estate which I may own at the time of my death, at private sale or at public auction, as he in his judgment may deem best, and authorize him to execute and deliver all deeds or instruments which may be necessary to convey said real estate to the purchaser or purchasers thereof.  I direct further that said real estate need not be sold by said executor until five years after my death, if he in his judgment should feel that a sale made prior to the expiration of such time will not bring a fair return for said real estate.
     3.  I give and bequeath the proceeds of the sale of said real estate, and all personal property which may remain in my estate after the payment of my debts and expenses, to my sons and daughters, Frank A Johnson, Arthur L Johnson, Robert L Johnson, Minnie Luers, Bertha Johnson, George P Johnson and Charles Sheldon Johnson, share and share alike.  All promissory notes which I may hold against any of said children at the time of my death, must be accounted for by such children, whether or not the same are barred by the Statutes of Limitations, but no  unpaid interest is to be charged on said notes.  Such accounting shall be made by listing such notes in the total of my estate and deducting the amount of any note held against any of said children from their respective shares.
     4.  I further direct that said real estate shall remain in charge of my son Robert L Johnson, until the same is sold and further direct that my said son Robert, who is now in possession of said real estate under a written lease, shall have the privilege of remaining in possession thereof until the same is sold, if he desires, by accounting to my estate for crop rental in the amount and on the terms in general effect in the community during such time.
     5.  I neither give, devise nor bequeath anything to my sons Walter E Johnson or Fred C Johnson, or to the widow or children of my son Benjamin L Johnson, for the reason that the said Walter E Johnson, Fred C Johnson and Benjamin L Johnson have already received from me in money and land their share of my estate.
     LASTLY, I nominate and appoint my son Robert L Johnson to be the executor of this my Last Will and Testament, and hereby revoke all Wills and codicils heretofore by me at any time made.
     In witness whereof I hereunto subscribe my name in the presence of witnesses this 9th day of October, 1931.

     We whose names are hereunto subscribed do hereby certify that on this 9th day of October, 1931, Clarence T Johnson to us personally know, did in our presence sign the foregoing instrument, and did at the same time in our presence and hearing declare the same to be his Last Will and Testament, and we at his request and in his presence and in the presence of each other, have hereunto subscribed our names as witnesses thereto.
